Terms of Service – Daktra AI
Welcome to Daktra AI (referred to as "we," "our," or "us"). By accessing or using the website builder and automated content generation tools of Daktra AI (referred to as the "Services"), you agree to comply with the following Terms of Service ("Terms"). Please read them carefully before using our platform.
1. Eligibility and Scope of Service (What We Provide and What We Do Not)
- Professional Use: Daktra AI is a business-to-business software as a service (B2B SaaS) designed specifically for healthcare providers and doctors to create independent websites and generate marketing copy.
- We Do Not Provide Medical Services: Daktra AI is a technical tool for building websites and writing copy only. We do not provide medical consultations, diagnostic tools, telehealth platforms, or tools for clinical patient management.
- No Patient Data or Appointment Booking: Daktra AI does not process patient health records, schedule medical appointments, or manage consultations. Users are strictly prohibited from using websites created through the platform to store or transmit sensitive or protected patient health information.
2. Accounts and Security
- You are fully responsible for maintaining the confidentiality of your Daktra AI account login credentials.
- You agree to notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Payments, Subscriptions, and Domain Purchases
- Subscription Fees: By subscribing to any plan on Daktra AI, you agree to pay recurring periodic fees until you cancel your subscription. Payments for active subscription periods are non-refundable.
- Domain Purchases Are Final and Non-Refundable: Unlike subscription fees, any fees paid to reserve a custom domain, renew it, or transfer it are processed through third-party registries and are non-refundable in all cases.
- Price Changes: We reserve the right to change subscription prices or domain purchase prices at any time with advance notice.
4. Custom Domains and DNS Services
If you use Daktra AI to register a new domain or connect a custom domain you already own, you explicitly agree to the following:
- Ownership and Eligibility: You retain ownership of any domain registered through our platform, provided your account is in good financial standing. You alone bear full responsibility for ensuring the domain name does not infringe on any third-party trademarks.
- Domain Expiration and Loss: If you cancel your subscription or fail to pay renewal fees, your domain may expire and be lost entirely. Daktra AI assumes no liability for lost domains, visitor disruption, or brand identity damage resulting from non-renewal.
- Third-Party Service Providers: Domain registration and connection services rely on third-party infrastructure (such as Cloudflare). We do not guarantee uninterrupted DNS accuracy, and we are not responsible for external network failures or configuration errors outside our platform's control.
5. AI-Generated Content Disclaimer
Daktra AI provides AI-powered copywriting tools to assist you in creating your website content. You alone bear full responsibility for reviewing, editing, and verifying the accuracy of any text published on your website. We are not liable for any inaccurate, misleading, or legally non-compliant professional statements generated by AI tools.
6. Content Ownership and Prohibited Use
- Your Content: You retain full ownership of all text, images, and logos you upload or publish on your independent website.
- Prohibited Use: You agree not to use Daktra AI to publish any illegal, deceptive, harmful, or unauthorized medical claims. The platform is also prohibited from being used to distribute malware, send spam, or conduct phishing operations.
7. Intellectual Property
- All software, website templates, AI engines, dashboard interfaces, and brand elements owned by Daktra AI remain our exclusive property.
- You may not copy, reverse engineer, or redistribute Daktra AI's core codebase or design templates outside the platform.
8. Limitation of Liability
Daktra AI is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Daktra AI and its founders shall not be liable for any indirect, incidental, or consequential damages, including loss of clinic/business profits, domain loss, or website downtime.
9. Termination of Service
You may cancel your subscription at any time through your dashboard. Upon cancellation, your independent website will remain active until the end of the current billing cycle, after which the website will be deactivated and disconnected from the custom domain.
